Stephen J. Del Sole maintains a diverse commercial litigation practice. Mr. Del Sole has extensive experience in defending manufacturers and suppliers in product liability cases involving industrial equipment, asbestos, drugs and vaccines, and chemical exposure. Mr. Del Sole's practice includes consumer finance litigation involving predatory lending practices, truth-in-lending and unfair trade practices claims. Mr. Del Sole represents media clients in First Amendment matters involving defamation claims and advocating the media's access to public records. His broad litigation background encompasses trade secrets/restrictive covenants, shareholder disputes, insurance coverage, licensing agreements, ERISA claims based upon breaches of fiduciary duties and third-party benefit administration agreements and general transactional disputes. Mr. Del Sole has successfully tried cases as a plaintiff and defendant before magistrates, juries, judges and arbitrators in state and federal trial and appellate courts.

Some of Mr. Del Sole's accomplishments include the following:

  • Obtaining a $13 million award following a two week trial in federal court for a manufacturing company and its ESOP in a complex action against former officers and directors of the company and trustees of the ESOP based upon breaches of fiduciary duties in the setting of executive compensation and in the enactment of lucrative executive pension plans.

  • Successfully defending a company, its subsidiary and its principal owners in substantively and procedurally challenging litigation brought by a minority shareholder who sought to compel the sale of 98% of the shares of the company for millions less than market value pursuant to rights of first refusal in a stock transfer agreement.

  • Securing dismissal on the eve of trial without any finding of liability for a manufacturer in products liability cases in the Northern District of West Virginia that involved plaintiffs who sustained severe amputation injuries as a result of being caught in the rollers of printing equipment manufactured by the client.

  • Enforcing the terms of a contractual arbitration provision to compel private arbitration and prohibit class litigation for a financial services client in a class action claim brought in Florida alleging breaches of state usury laws, violations of the Unfair Trade Practices Act and the Truth-In-Lending Act.

  • Obtaining dismissal of a multi-count defamation action in the United States District Court for the Western District of Pennsylvania seeking reputation and punitive damages in excess of $1 million against a media client in a claim arising out of newspaper reports on the criminal indictment of a real estate developer.

  • Representing the manufacturer of a spray-on asbestos fireproofing product in an action brought by the owner of a commercial office building in Manhattan that sought over $250 million in damages for asbestos removal and diminution in value. The litigation team obtained an award for less than 5% of the total claims following a several-week trial in New York.

Mr. Del Sole is admitted to the bars of Pennsylvania and West Virginia as well as the United States District Courts for the Western District of Pennsylvania, and the Southern and Northern Districts of West Virginia. He is a member of the Allegheny County Bar Association and the Pennsylvania Bar Association and serves on the Council for the Civil Litigation Section of the ACBA. Mr. Del Sole has also taught Pennsylvania civil practice at Duquesne Law School.

Mr. Del Sole maintains an active interest in civil and charitable causes. He handles pro bono adoption cases through a joint Reed Smith/Children, Youth and Family Services adoption program. He serves as Regional Coordinator for the Pennsylvania Bar Association State-Wide High School Mock Trial Competition. He served as event chair for the Pressley Ridge Institute Ice Cream Sunday fundraising event to provide services to disadvantaged children, and is an active participant in the "Christmas in April" program which provides needy Pittsburgh-area residents with home improvement assistance.

Mr. Del Sole received his B.A. from Penn State University in 1990. He received his J.D. from the Duquesne University School of Law in 1994 where he was a published member of the Duquesne Law Review. While in law school, Mr. Del Sole placed first in the Gourley Cup Team Moot Court Competition, was the recipient of an American Jurisprudence Award and was elected to the Order of the Barristers.

A native Pittsburgher, Mr. Del Sole lives in the Shadyside section of town with his wife and children.
